Title Certificate FAQs

Updating or changing your Certificate of Title is a necessary process whenever a significant change happens with any owner of the property.

This includes changes to your legal name, which may come with marriage (or a breakdown of). You would be required to submit a number of forms.

Updating title details is also necessary if a property owner has passed. However, there is no immediate necessity to do this - you can wait until the time you need to sell the property.

As such, it is wise to engage a conveyancer to help you with these processes.

What is a Title Certificate?

A Certificate of Title is a legal document identifying land ownership, including interests and restrictions of the land.

Your title will contain:

  • A description of the land;
  • First Schedule - which lists the owner who is guaranteed by the state; and
  • Second Schedule - which lists all the registered interests that affect the land.
